The Ancient Coin Collectors Guild Case

[The Ancient Coin Collectors Guild (ACCG) sued the Department of State, U.S. Customs and Border Protection and the Department of Homeland Security and requested that Chinese-type and Cypriot-type coins be excluded from import restrictions granted under the Cultural Property Implementation Act to the People’s Republic of China and Cyprus.  ACCG argued that the Government improperly promulgated and applied regulations imposing import restrictions on ancient coins and that the U.S. government failed to satisfy the “first discovery” requirement under the CPIA, as ancient coins were widely minted in ancient times and were widely dispersed outside the modern country in which the coin was either minted or “first discovered.”  The suit noted that the inclusion of broadly described categories of coins in the Chinese and Cyrus MOU’s placed an impossible compliance burden on prospective importers.]
